In a move that now makes Fuji Xerox Australia Pty Ltd (100% owned by Fujifilm Holdings) the Defendant as well as the Plaintiff, Neil Whittaker and EY (Ernst & Young) have both filed Cross-Claims against the company.

Former Fuji Xerox managing director for New Zealand and Australia, Neil Whittaker has filed a cross-claim against his former employer, in the Federal Court of Australia. This joins EY's Sept 4th filing of a cross-claim against its former client for accounting and financial services.

The case revolves around the so-called 'accounting scandal' that cost Fuji Xerox over $450 million and several senior managers their jobs, and was used by investors Carl Icahn and Darwin Deason to torpedo Fujifilm's proposed $6 billion takeover of Xerox.

Cross-claims in contentious civil proceedings are not unheard of but must usually prove pecuniary loss. Reputational damage alone is normally not sufficient to win a cross-claim.

Wideformat Online has applied to the Federal Court for permission to sight the Whittaker cross-claim documents. He has denied any wrongdoing whatsoever.
